brasteloni.top provides fitness client retention analytics dashboards and business intelligence solutions for gyms, fitness centres, and related businesses. Our services include but are not limited to:

  • Member engagement tracking and insights
  • Custom analytics dashboards and visualisations
  • Business intelligence consulting services

3. User Obligations

As a user of our services, you agree to:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are quoted in Euros (EUR) unless otherwise specified
  • Payment is due within 30 days of invoice date
  • Late payment may result in service suspension or termination
  • Refunds may be available in accordance with our refund policy

6. Intellectual Property

The brasteloni.top website, analytics platform, and all related software, documentation, and materials are the intellectual property of brasteloni.top Ltd and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use our services for your internal business purposes. This licence does not permit you to:

  • Copy, modify, or create derivative works of our software or platform
  • Reverse engineer, decompile, or disassemble our technology
  • Remove or alter any proprietary notices or labels
  • Use our services to develop competing products or services
  • Share your account access with unauthorised third parties

7. Service Availability

Whilst we strive to provide continuous service availability, we do not guarantee that our services will be uninterrupted or error-free. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

8. Limitation of Liability

Our total liability to you for all claims arising from or relating to these Terms or our services shall not exceed the amount you paid to us for our services in the twelve months preceding the claim.

  • By us: for breach of these Terms, non-payment of fees, or for any reason with 30 days' notice
  • Automatically: if you fail to comply with these Terms

Upon termination, your right to use our services will cease immediately. We may delete your data in accordance with our data retention policies, though we will provide reasonable opportunity for you to retrieve your data.

12. Force Majeure

Neither party shall be liable for any failure or delay in performance under this agreement which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond the reasonable control of such party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our website or by email. Your continued use of our services after such notice constitutes acceptance of the modified Terms.

15. Severability
